Making a Will
A Will is a legal document that states what you would like to happen to your assets when you die. This can include, property, savings, vehicles and all other possessions you hold.

By making a Will removes the laws of intestacy and means that you have decided on how your assets will be distributed and to whom.

Some of the benefits of making a Will include:

-
Appointing guardians of minor children
-
Make gifts and donations
-
State your funeral wishes
-
Decide on who the beneficiaries of your assets are
-
Exclude potential claimants
-
Appoint Executors and Trustees
-
Less stress for the surviving relatives and family
-
Peace of mind knowing that you have outlined your wishes and who your beneficiaries are after death
Creating a Lasting Power of Attorney
A Lasting Power of Attorney is a legal document that enables you to appoint people you trust to make decisions for you if you are unable to do so yourself.

There are two types of Lasting Power of Attorney:

-
Property and Financial which allows Attorneys to look after your finances and property affairs.
-
Health and Welfare which allows Attorney to deal with day-to-day care, where you live, medical treatment, alternative therapies, expressing your personal wishes and beliefs and end of life decisions.
Without a Lasting Power of Attorney, your family will need to obtain permission to act for you from the Court of Protection. This can be a very stressful and expensive process that can take several months and cost thousands of pounds in legal and medical fees. In the meantime, your family will be unable to legally assist you with your affairs.

Some of the benefits of Making a Lasting Power of Attorney:

-
Practical powers to be able to assist you at a time you need it most
-
Avoiding the stress and expense of applying to the Court of Protection
-
Peace of mind for you and your family knowing that you have established Lasting Powers of Attorneys and registered through the Office of the Public Guardian (OPG)

Trusts
Including Trusts in your Will can be a useful way of protecting assets.
There are many different Trusts that can be used, which will depend on your objectives and circumstances.

Some of the benefits of using Trusts are:

-
Ensuring your children’s inheritance is protected upon spousal remarriage
-
Protecting children’s inheritance if they get divorced
-
Protecting some of your assets against future care costs
-
Protecting assets for disabled beneficiaries
-
Trusts provide peace of mind knowing that assets can be preserved for unforeseen circumstances in the future after you have died
